POPIA. Terms of Use & Consent to Process Personal Information

These Terms of Use and this Consent Notice ("the Terms") govern your use of the Jobzas platform, including our WhatsApp service and website ("the Platform"). Jobzas ("we", "us", "our") is a South African platform operated in compliance with the Protection of Personal Information Act, 4 of 2013 ("POPIA"). By sending a message to our WhatsApp number, submitting your details through the Platform, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms and that you give the consents set out below.
1. What POPIA is
POPIA is South Africa's data protection law. It gives you rights over your personal information and places duties on us as a "responsible party" to collect, use, store, and share your information lawfully, transparently, securely, and only for a clear purpose. We take those duties seriously. the trust of the workers and employers who use Jobzas is the foundation of this Platform.
2. The personal information we collect
To create your worker profile and connect you with potential employers, we collect the following personal information directly from you via WhatsApp:
- Your full name and surname;
- A photograph of your South African identity document or smart ID card, including your identity number;
- A photograph of your face (used as your profile picture and to verify your identity);
- Your contact details, including your WhatsApp/cellphone number;
- Your residential area and/or location information you choose to share;
- Your work history, skills, experience, availability, expected pay, and the details of references (previous employers) you provide;
- Any other information you voluntarily provide in your messages to us.
Some of this information. including your identity number and biometric photographs. is treated by POPIA as requiring special care. We only process it with your express consent, which you give under section 5 below.
3. Why we collect it (purpose)
We process your personal information only for the following purposes:
- To create and maintain your worker profile on the Platform;
- To verify that you are who you say you are and that you are eligible to work in South Africa;
- To display your profile (photograph, first name, skills, general area, experience, and availability) to registered employers searching for workers;
- To share your contact details with an employer only when that employer takes a deliberate step to connect with you;
- To contact you about your profile, job opportunities, and the operation of the Platform;
- To keep the Platform safe, prevent fraud, and comply with the law.
We do not sell your personal information. We do not use it for purposes unrelated to finding you work.
4. How we store and protect it
- Your information is stored on secure, access-controlled servers using encryption in transit and at rest;
- Photographs of identity documents are stored separately from your public profile and are never displayed to employers;
- Access to identity documents is restricted to authorised Jobzas personnel strictly for verification purposes;
- We retain your information only for as long as your profile is active, or as long as the law requires. If you ask us to delete your profile, we will remove your personal information within a reasonable time, subject to any legal retention obligations.
6. Your rights under POPIA
You have the right, at any time, to:
- Ask us what personal information we hold about you;
- Ask us to correct or update your information;
- Ask us to delete your information and close your profile;
- Object to the processing of your information;
- Lodge a complaint with the Information Regulator (South Africa): complaints.IR@justice.gov.za / www.inforegulator.org.za.
7. General terms of use
- The Platform is free for job seekers. We will never ask a job seeker to pay to create a profile or to be connected with an employer;
- You must be 18 years or older to create a worker profile;
- You may not create a profile on behalf of another person without their knowledge and consent;
- Providing false information, false documents, or false references is a material breach of these Terms and will result in removal from the Platform;
- Jobzas is a connection platform. We are not the employer, an employment agency, or a party to any employment agreement concluded between a worker and an employer. Workers and employers are responsible for their own dealings, and both parties should take reasonable care. including meeting in safe circumstances and confirming terms of work in writing;
- To the maximum extent permitted by law, Jobzas is not liable for any loss or damage arising from the conduct of any worker or employer introduced through the Platform;
- We may update these Terms from time to time. The latest version will always be available on this page, and continued use of the Platform constitutes acceptance of the updated Terms.
